1. Introduction

Welcome to konverg.io! By using our services, you agree to abide by these Terms of Service ("Terms"). Please read them carefully as they outline your rights and responsibilities when using konverg.io

2. Eligibility

To use konverg.io, you must comply with your local laws, including those regarding the legal age to start a business or collect payments. We do not have a specific age limit, but all users must have access to a valid credit card.

3. Account Creation

To create an account, you must provide:

- Full name

- Valid email address

- Phone number

- Payment method

Multiple accounts created to exploit free trials are prohibited. Any abuse of this will lead to the termination of your account(s).

4. Account Termination

We reserve the right to terminate accounts for violations including, but not limited to:

Misuse of the serviceViolation of these termsOperating fraudulent businessesEngaging in harmful or illegal activities

5. Service Availability

While we strive to ensure our services are always available, konverg.io may experience downtime due to maintenance or unforeseen issues. We are not liable for any interruptions to service.

6. Prohibited Activities

Users of konverg.io may not:

Engage in spammingConduct illegal activitiesResell our services (excluding our affiliate program)

7. User Responsibilities

Users are solely responsible for the accuracy of the information they provide and how they use the software.

8. Limitations on Usage

Each subscription package includes credits for email, SMS, AI tools, and automations. Users may purchase additional credits as needed. There is no limit to usage within the purchased credits.

9. Payment Terms

Payments are processed via Stripe. We accept credit cards and Visa/MasterCard debit cards. A valid payment method is required for a 14-day free trial, and users may choose between monthly and annual billing options.

10. Refund Policy

konverg.io does not offer refunds. We make no guarantees regarding your business success while using our platform.

11. Late Payments

If your payment method fails, your services will be suspended until the balance is paid. No additional fees are applied for late payments, but access will be restricted. Account cancellation will not be finalized until balances owing are paid in full to konverg.io .

12. Ownership of Content

Users retain ownership of all content they create, including websites and course materials. konverg.io reserves the right to draw inspiration from user-created content (such as templates) but will not directly copy your work.

13. Intellectual Property

All software, logos, and brand assets of konverg.io are the intellectual property of konverg.io. Users may not copy, modify, or distribute any intellectual property without permission.

14. Third-Party Integrations

konverg.io

offers numerous third-party integrations and supports custom API integrations. There are no significant limitations on third-party usage.

15. Limitation of Liability

konverg.io is not liable for any data loss, interruptions in service, or other damages arising from the use of our platform. Users agree to use konverg.io at their own risk.

16. Governing Law

These terms are governed by the laws of Ontario, Canada. Any disputes will be resolved under Ontario jurisdiction.

17. Dispute Resolution

Before initiating legal action, users agree to attempt arbitration or mediation to resolve any disputes related to these terms or the use of our services.

18. Modifications to Terms

konverg.io reserves the right to modify these Terms at any time without notice. We recommend users review these Terms periodically to stay informed of any updates.

19. Support Availability

Support is available 24/7 through live chat and email. Additional video meetings can be scheduled for an extra subscription fee.

20. Maintenance and Updates

We reserve the right to update or modify any features of the software at any time to improve the user experience.

21. Termination by User

Users may terminate their accounts at any time with no penalties. Once terminated, access to the services and any related data will be revoked.

22. Cancellation Policy

All of our subscriptions are no-contract and clients are free to cancel with a minimum of 30 days notice from their next billing date. Prior to cancellation it is your responsibility to ensure all media assets, customer lists, configured features (templates, workflows etc.), funnels, websites, and phone numbers are transferred or removed from service.

Once your cancellation is processed this is irreversible and all data within the system will be purged including any phone numbers purchased through the system. If you'd like to transfer out any actively used phone numbers it will be your responsibility to submit the porting request to do so.

In lieu of cancelling your account permanently you may opt to suspend your billing for a short specified period of time after which point we will be able to resume your account. During this time all access, communications (Phone/SMS/Email), websites, automations, and other services will be paused. You will be responsible for the direct maintenance fees of phone numbers charged by the carrier however they will not be terminated/released. All functions and billing will automatically resume after the specified period of time. Suspensions are limited to 90-day spans after which billing will resume for a minimum of 30 days.
